daf bit followup

[livejournal.com profile] ariannawyn, I meant that, talmudically (this has changed since), having relations with an elligible partner is enough to enact a marriage -- no legal contract necessary. So, essentially, he's married her but not fulfilled his up-front obligation.

(How, then, can you have prostitution qua prostitution at all in this system? That's a good question, and aside from the cases where the marriage would be forbidden, I'm not sure.)

Having relations with an eligible partner in itself is not enough to enact a marriage -- you also have to have the (IIRC, spoken) intention of doing so.
