Feb. 12th, 2009 08:51 amThe mishna teaches: if an ox gores a cow and its newly-born calf is
found dead nearby, but it is not known if the birth occurred before
or after the goring, then the owner of the ox pays half damages for
the cow (that's normal) and quarter damages for the calf. The g'mara
disagrees on the latter; the sages say that the burden of proof is always on
the claimant, even if the claimant is positive and the defendant is dubious.
